  3. Agreements and Expectations
    • All project terms, including deliverables, timelines, and payment milestones, must be agreed upon before the project begins.

4.2 Payments

Our payment system is designed to ensure secure, efficient, and transparent transactions for both Freelancers and Clients:

    • Payments for projects are held in escrow to protect both parties. Clients deposit funds into the escrow account at the start of the project.
    • Funds are released to Freelancers only after the Client approves the completed work, ensuring fairness and trust.
  2. Supported Payment Gateways
    • Forhopp integrates with trusted payment gateways, including Stripe, PayPal, and local bank transfers.
    • Clients can pay in their preferred currency, and Freelancers can withdraw funds in over 50 supported currencies, minimizing conversion fees.
  3. Timely Payouts
    • Freelancers can request payouts once their earnings reach the minimum withdrawal threshold.
    • Payments are processed within 1-5 business days, depending on the withdrawal method.
  4. Tax Compliance
    • Freelancers are responsible for reporting their earnings to local tax authorities. Forhopp provides downloadable payment records to assist with tax filings.
    • Clients may be required to provide tax-related documents, depending on their jurisdiction.

4.3 Fees and Charges

Forhopp maintains a transparent and tiered fee structure to ensure affordability and fairness for all users:

      • Level 1 Freelancers (beginners): Lowest commission rate to support newcomers.

    • The tiered system incentivizes skill development and platform loyalty while maintaining fairness for all users.
  2. No Fees for Clients
    • Unlike other platforms, Forhopp does not charge Clients any fees for posting projects, hiring Freelancers, or managing payments through the platform.
  3. Optional Add-Ons
    • Freelancers and Clients can purchase optional add-ons for enhanced visibility and success, such as:
      • Profile Boosts: Increase profile visibility in search results.
      • Project Promotion: Highlight projects to attract top talent.
      • Skill Verification Badges: Showcase verified expertise to build trust.
  4. Currency Conversion and Withdrawal Fees
    • Freelancers withdrawing in a currency other than USD may incur a small conversion fee, displayed transparently during the withdrawal process.
  5. Taxes
    • Any applicable taxes, including VAT or GST, will be displayed during the transaction and deducted accordingly.

4.4 User Responsibilities in Transactions

  1. Freelancers
    • Freelancers must deliver services as per the agreed terms, maintaining professional quality and adherence to deadlines.
    • Failure to meet agreed standards or timelines may result in disputes, delayed payments, or account penalties.
  2. Clients
    • Clients are expected to provide clear and detailed project requirements.

5. Intellectual Property Rights

    • If ownership transfer is part of the agreement, the Freelancer must provide the Client with all necessary rights, permissions, and documentation upon project completion and payment clearance.
  2. Licenses Granted to Forhopp
    • By using Forhopp, you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and adapt your content for purposes such as platform promotion, service enhancement, and legal compliance.
    • This license does not grant Forhopp ownership of your intellectual property; it is limited to platform functionality and marketing activities (e.g., showcasing your portfolio on your profile).
  3. Responsibility for Content
    • Users are solely responsible for ensuring that their content does not infringe on the intellectual property rights of others. This includes obtaining appropriate licenses or permissions for any third-party materials used.
    • Forhopp reserves the right to remove any user-generated content found to violate intellectual property laws or our platform policies.

    • This license does not include the right to copy, distribute, or reverse-engineer any part of the platform.
  3. Third-Party Integrations and Content
    • The platform may include content, features, or integrations provided by third parties (e.g., payment gateways or analytics tools).
    • These integrations are governed by their respective intellectual property and licensing terms, and users must comply with those terms when interacting with such features.
  4. Unauthorized Use
    • Users found engaging in unauthorized use of Forhopp’s intellectual property may face account suspension, termination, and/or legal action. This includes but is not limited to:
      • Copying or mimicking the platform’s design or functionality.

    • Users may opt-out of promotional showcasing by contacting Forhopp support.

6. Payment Terms

Forhopp is dedicated to ensuring secure, transparent, and efficient payment processes. This section outlines the terms governing payments, the role of the escrow system, refund policies, and user responsibilities.

6.1 Escrow System

Our escrow system is designed to protect both Clients and Freelancers by securely holding funds until project milestones are met or deliverables are approved.

    • Ensures that funds are available for Freelancers before they begin work.
    • Provides Clients with confidence that payments will only be released upon satisfactory completion of work.
  2. How Escrow Works
    • Deposit: Clients deposit the agreed-upon project amount into the escrow account before work begins.
    • Milestone Payments: For milestone-based projects, funds are released in stages as agreed milestones are completed and approved.
    • Final Release: Once the entire project is completed and approved by the Client, the remaining funds are released to the Freelancer.
  3. Dispute Scenarios
    • If a dispute arises regarding the release of escrow funds, Forhopp’s dispute resolution process will be initiated.
    • Funds will remain in escrow until a resolution is reached, ensuring neither party is unfairly disadvantaged.
  4. Timeframes

    • Payments are typically released to Freelancers within 1-5 business days after approval by the Client.

6.2 Payment Methods

    • Payments can be made in multiple currencies, with currency conversion rates transparently displayed during transactions.
  2. Payout Options for Freelancers
    • Freelancers can withdraw funds via their preferred method, including local bank transfers, PayPal, and direct deposit.
    • Withdrawal processing times vary depending on the selected method, typically ranging from 1-5 business days.
  3. Fees and Charges
    • Payment gateway fees may apply based on the selected method and region. These fees are displayed transparently at the time of transaction.
    • Currency conversion fees may apply for withdrawals in a currency other than USD.

6.3 Refund Policy

Forhopp offers a fair and transparent refund policy to protect both Clients and Freelancers.

  1. Eligibility for Refunds
    • Refunds may be granted in the following cases:
      • Project Cancellations: When both parties agree to cancel a project before work has commenced.
      • Non-Delivery: If the Freelancer fails to deliver the agreed-upon services.
      • Unsatisfactory Work: In cases where deliverables do not meet the agreed standards or specifications, and the Freelancer is unable to make corrections.
  2. Process for Requesting Refunds
    • Clients can initiate a refund request through their project dashboard.
    • Both parties are encouraged to resolve disputes amicably before seeking platform intervention.
  3. Approval and Timeline

    • Refunds are issued to the original payment method used by the Client.
  4. Non-Refundable Situations

6.4 Taxes and Compliance

    • Freelancers are solely responsible for reporting their earnings and complying with tax laws in their respective jurisdictions.
    • Forhopp provides earnings reports and invoices to assist Freelancers with tax compliance.
  2. VAT and Sales Tax
    • Forhopp collects and remits VAT, GST, or similar taxes where required by law.
    • Clients and Freelancers will be notified of any applicable taxes during the payment process.

6.5 User Responsibilities

  1. Clients
    • Ensure timely payment of project funds to avoid delays.
    • Provide clear feedback and approvals to facilitate smooth project completion and payments.
  2. Freelancers
    • Accurately report project progress and submit deliverables within the agreed timeframe.
    • Avoid requesting payments outside the Forhopp platform, as this violates our Terms and nullifies platform protection.

6.6 Forhopp’s Role in Payments

  1. Facilitator, Not Party to Contracts
    • Forhopp acts as a payment facilitator and does not assume liability for project disputes, non-payment, or failed deliverables unless arising directly from platform errors.
  2. Security Measures
    • All payments are encrypted and processed using secure gateways to protect user data.
  3. Dispute Mediation
    • Forhopp provides mediation services to resolve payment disputes but does not guarantee outcomes favorable to any party.

6.7 Termination and Non-Compliance

  1. Termination of Accounts
    • Users found violating payment terms or circumventing Forhopp’s systems may have their accounts suspended or terminated.
  2. Non-Compliance with Taxes
    • Users failing to comply with applicable tax laws may face account restrictions or reporting to relevant authorities.
  3. Recovery of Funds
    • Forhopp reserves the right to recover fees or funds owed due to fraudulent activity, misuse, or breaches of these Terms.

7. Dispute Resolution

Forhopp understands that, occasionally, conflicts may arise between Clients and Freelancers during or after the completion of projects. We are committed to providing a fair, transparent, and efficient mechanism for resolving disputes, ensuring that both parties have an opportunity to present their case and reach a resolution in a timely manner.

7.1 Internal Dispute Mechanism

  1. Purpose and Scope of Dispute Resolution
    • At Forhopp, we aim to resolve disputes quickly and effectively, minimizing the impact on the working relationship between Clients and Freelancers.
    • This mechanism applies to any disputes that arise regarding the quality of work, unmet expectations, or payment-related issues.
  2. Filing a Dispute
    • Timeframe for Filing: Disputes must be reported to Forhopp’s support team within 7 days of the project’s completion. This time frame ensures that the details of the project are still fresh and relevant.
    • How to File: To initiate a dispute, either the Client or the Freelancer must contact Forhopp’s support team through the platform’s internal messaging system or via [email protected]. The dispute request should include:
      • A clear description of the issue.
      • Relevant supporting documentation, including project agreements, work submitted, communication records, and any other evidence that may assist in resolving the dispute.
      • Specific outcomes sought (e.g., refund, revisions, or clarification of terms).

    • Once a dispute is filed, Forhopp will review the provided documentation and communicate with both parties involved.

      • Partial Refund: In cases where the Client is unsatisfied with a portion of the work, a partial refund may be provided.
      • Full Refund: If the work is deemed unsatisfactory and no resolution can be reached, a full refund may be issued to the Client.
      • No Action: If the dispute is deemed unfounded or insufficient evidence is provided, Forhopp may close the case without action.
  4. Enforcement of Mediation Results
    • Both the Client and Freelancer are expected to abide by the results of the mediation. If either party does not adhere to the resolution, Forhopp reserves the right to suspend or terminate the user’s account, as appropriate.

    • If a dispute cannot be resolved through Forhopp’s internal mediation process, or if either party refuses to comply with the mediation outcome, the dispute will proceed to binding arbitration.
    • Arbitration is the final step in dispute resolution and is intended to ensure that both parties receive a fair and impartial decision.

    • Non-compliance with any of Forhopp’s Terms and Conditions, including but not limited to fraudulent activity, illegal conduct, or abuse of the platform’s resources.
    • Engaging in activities such as spamming, intellectual property infringement, harassment, or misuse of the platform for activities that violate laws and regulations.
    • Failure to comply with specific terms agreed upon when using our Services, including breach of contractual agreements between Freelancers and Clients.
  2. Non-payment or Non-compliance
    • Failure to pay for services rendered, incomplete payment, or attempts to manipulate payment systems within Forhopp.
    • Failure to provide accurate and truthful information during registration or at any time during use, leading to trust issues and possible legal implications.
  3. Security Violations
    • Any attempts to breach or bypass the security measures set by Forhopp, including hacking, phishing attempts, or use of malicious software to harm the platform or other users.
  4. Fraudulent Activity
    • Engaging in fraudulent behavior, such as scamming clients, misleading freelancers, or attempting to collect funds through deceitful means.

9.2 Account Termination Process

  1. Immediate Termination
    • If a user is found to be in violation of these terms in a severe manner, Forhopp may suspend or terminate the account immediately without prior notice. Such violations include but are not limited to fraudulent activities, hacking attempts, or activities that could endanger the platform’s users.
  2. Notice and Review
    • If an account is suspended for violations, Forhopp will send a notification via email or through the platform’s messaging system detailing the cause for suspension.
    • The user will have 7 days from the notification date to provide an explanation or contest the termination.
    • If, after reviewing the user’s explanation, the suspension is found to be unjustified, the account will be reactivated. If the suspension is justified, the account will be permanently terminated.
  3. User Appeal Rights
    • Users whose accounts have been suspended or terminated have the right to appeal the decision.
    • To appeal, the user must contact Forhopp’s support team via  within 7 days of receiving the termination notice, stating reasons why the account should be reinstated.
    • Forhopp will review the appeal, and users will be informed of the decision within 7 business days. The appeal process is designed to ensure fairness and transparency.

9.3 Handling of Account Balances Upon Termination

  1. Refunds
    • Upon termination of an account, the user’s remaining funds in their Forhopp wallet will be handled based on the account balance at the time of termination.
    • If the user has an account balance below 30 USD, Forhopp reserves the right not to return the funds. This is because the cost of processing such small amounts (due to transaction fees) may exceed the funds in the wallet, making it impractical to return them.
    • Users with balances above 30 USD are eligible for refunds, and the remaining balance will be refunded using the same method that was used for depositing the funds.
  2. Refund Requests
    • Users whose accounts have been terminated for reasons outside their control may request a refund for the amount above 30 USD if they meet the criteria for eligible account balances.

9.4 Modification or Discontinuation of Services

  1. Right to Modify Services
    • Forhopp reserves the right to modify, suspend, or discontinue any service, feature, or function on the platform without prior notice. This includes but is not limited to changes in service pricing, the introduction of new features, or the suspension of certain tools.

    • In case of platform discontinuation or service suspension, Forhopp will make reasonable efforts to notify users and provide an opportunity to withdraw any remaining balances.

    • Forhopp is not liable for any loss of earnings, damages, or inconveniences incurred as a result of account termination, whether initiated by the user or by Forhopp for any reason as outlined in these Terms.
    • Termination may also result in the permanent loss of user data, including past transaction history, communications, and other content associated with the account.

    • Both Clients and Freelancers must comply with all applicable laws related to the use of Forhopp services, including intellectual property rights, tax laws, and regulations related to online payment processing.

  2. User’s Responsibility Upon Termination
    • Upon termination of an account, users are required to resolve any outstanding payments, disputes, or commitments with Clients or Freelancers. Termination of an account does not absolve users of these obligations.
    • It is the user’s responsibility to retrieve and back up any important data before account termination.

10. Limitation of Liability

At Forhopp, we take every possible step to ensure a smooth and reliable user experience. However, we recognize that certain events are beyond our control, and as such, we must clarify the limitations of our liability with respect to the services provided on the platform.     • Disputes Between Users: Forhopp is not responsible for resolving disputes related to the execution or failure of contracts, disagreements on the quality of work, or unmet expectations between clients and freelancers.
  2. Technical Disruptions
    • Outages and Delays: While Forhopp works to maintain a high level of uptime and stability, we cannot be held liable for service interruptions, technical failures, or delays on the platform, whether due to server issues, software bugs, DDoS attacks, or natural disasters.

  • The total amount of fees paid by the user for the specific transaction related to the issue, dispute, or claim.   • Exclusion of Indirect Damages: We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, goodwill, or business opportunities.
